Terms of Service

1. Services

The Domain Forge ("we," "us," "our") provides website design, development, domain registration, hosting, SEO optimization, and ongoing maintenance services for small businesses. By engaging our services, you ("Client") agree to these terms.

2. Monthly Billing & Payment

Monthly plan fees are billed on the same date each month starting from your site launch date. Payment is due within 7 days of invoice. We accept payment via credit card, Stripe, Venmo, or check.

If payment is more than 14 days overdue, we reserve the right to temporarily take your website offline until payment is received. If payment is more than 30 days overdue, we may suspend services entirely.

3. One-Time Payment Option

Clients may choose a one-time payment option instead of monthly billing. One-time payments cover 12 months of hosting and maintenance. After 12 months, a reduced hosting-only fee applies.

4. Cancellation

You may cancel your monthly plan at any time with 30 days written notice to contact@thedomainforge.com. No cancellation fees or penalties apply.

• Upon cancellation, your website will be taken offline at the end of your billing period.
• If you own a custom domain registered through us, we will transfer it to you at no additional cost upon request.
• Website source files can be provided upon request for a one-time fee of $50.

5. Intellectual Property

All website designs, code, and creative work produced by The Domain Forge remain our intellectual property until the Client has paid in full for the project. Upon full payment:

• The Client owns the content they provide (text, photos, logos).
• The Domain Forge retains the right to showcase the work in our portfolio.
• Custom code and design templates remain the property of The Domain Forge but are licensed to the Client for their use.

6. Client Responsibilities

• Providing accurate business information, content, and materials in a timely manner.
• Ensuring all content provided is legally owned or licensed by the Client.
• Reviewing and approving designs and content before publication.
• Maintaining current payment information.

7. Content & Legal Compliance

The Client is solely responsible for ensuring all content on their website complies with applicable laws and regulations. We will not publish content that is illegal, defamatory, discriminatory, or infringes on third-party rights.

8. Limitation of Liability

The Domain Forge is not liable for any indirect, incidental, or consequential damages arising from the use of our services. Our total liability shall not exceed the total amount paid by the Client in the 12 months preceding the claim.

9. Website Availability

While we strive for 99.99% uptime, we cannot guarantee uninterrupted service. We are not responsible for downtime caused by third-party hosting providers, DNS issues, or circumstances beyond our control.

10. Modifications

We reserve the right to update these terms at any time. Clients will be notified of material changes via email. Continued use of our services after notification constitutes acceptance of the updated terms.
